L'organisation mondiale du commerce (OMC) a estimé le 19 mai 2008 que le système d'importation de bananes de l'Union européenne contrevenait aux règles du commerce international, donnant ainsi raison aux Etats-Unis. Les juges de l'OMC dans leur rapport final ont conclu que le quota tarifaire préférentiel prévu par les règles d'importation de l'UE réservé aux pays Afrique- Caraïbes-Pacifique (ACP) est incompatible avec les règles du commerce international. En effet, le régime d'importation européen impose un droit de douane de 176 euros par tonne pour les bananes non originaires de la zone ACP.
