@Creer son cabinet et reussir dans le droit des affaires, c'est possible... a certaines conditions
Les grands cabinets tiennent le marché du droit des affaires. Les secrétaires généraux et les directeurs juridiques ne veulent que des « marques » ... De tels propos sont souvent tenus et il est indéniable que l'évolution de la pratique du droit des affaires au cours de ces vingt dernières années a concentré entre les mains des cabinets importants une part considérable du marché.
Il y a cependant des avocats d'affaires qui ont fait le choix de structures dont ils sont les dirigeants et qui n'ont pas pour autant voulu sacrifier la qualité des dossiers ou l'importance des enjeux. Nous avons voulu interroger à la fois des avocats qui ont fait ce choix il y a une quinzaine d'années alors qu'ils avaient à peine trente ans ainsi que des avocats qui ont pris cette même décision plus récemment. Les témoignages sont particulièrement intéressants et nous confirment que même dans un marché très concurrentiel, il est possible de percer si on en a le talent et qu'on fait les bons choix.
Alors qu'une grande partie de la génération d'avocats qui ont autour de quarante ans aujourd'hui a été absorbée par les années de croissance des bureaux parisiens des cabinets mondiaux, il semble que les créations de cabinets se réveillent, prouvant qu'il n'est pas toujours nécessaire de travailler à 100 pour pratiquer le droit des affaires.

Il y a des avocats qui ont la fibre indépendante et qui ne veulent pas des contraintes et des procédures des grandes structures. Quand ces mêmes avocats veulent traiter des dossiers intéressants pour des clients importants, ils savent que l'indépendance n'est pas sans risques. Nous avons choisi deux exemples d'avocats qui, bien qu'ayant à peine trente ans, ont estimé qu'ils pouvaient se lancer dans l'arène. Créateurs de leurs cabinets, en 1994 pour l'un et en 1990 pour l'autre, nous avons décortiqué avec eux les explications de leur réussite.
Pascal Wilhelm a créé son cabinet, Wilhelm & Associés, en 1994. La structure compte aujourd'hui 5 associés et 13 collaborateurs. Il avait trente ans et avait prêté serment six ans plus tôt. Son exemple est intéressant car peu d'avocats ayant prêté serment à la fin des années quatre-vingt ont réussi à créer ex-nihilo des cabinets qui sont les conseils attitrés de certaines des sociétés françaises les plus importantes. La génération de Pascal Wilhelm est celle des avocats qui ont fourni les forces vives de l'implantation et de la croissance des cabinets anglais et américains à Paris.
Pascal Wilhelm a eu le talent de comprendre très tôt ce que d'autres avocats de sa génération ont compris trop tard. « Il fallait être un cabinet de niche dès le départ », explique-t-il. En effet, il s'est lancé avec deux spécialités : le droit de la publicité et le droit de la distribution. Quatorze ans plus tard, il est encore fidèle à ses choix initiaux et il a été récompensé pour sa persévérance. Il est entre-autres le conseil de Canal + et d'Auchan. Malgré sa taille, son cabinet est structuré autour de trois pôles : droit économique, droit de la communication et le droit des sociétés, cette dernière équipe se consacrant essentiellement au contentieux et aux affaires de haut de bilan.
Pour Jean Reinhart, associé fondateur de Reinhart Marville Torre, cabinet de 46 avocats dont 15 associés, la création de son cabinet n'était pas préméditée. Formé pendant quatre ans chez Siméon, Moquet, Borde, il ne savait pas s'il devait suivre Siméon ou s'il devait suivre Moquet et Borde quand le cabinet a éclaté en 1990. Il décida donc de ne suivre personne et d'accrocher sa plaque avec la conviction que le cabinet qu'il allait créer devait être une structure capable d'éviter les querelles...
