CEDH : condamnation de la France pour violation de la liberté d'expression de deux journalistes

La France a été condamnée par la Cour européenne des droits de l'homme (CEDH), le 7 juin 2007, pour violation de la liberté d'expression de deux journalistes coauteurs d'un livre sur les écoutes de l'Elysée. Dans cette affaire, le directeur adjoint du cabinet du président François Mitterrand à l'époque des écoutes, déposa plainte avec constitution de partie civile contre les deux journalistes des chefs de recel de documents provenant d'une violation du secret professionnel, recel de violation du secret professionnel et recel de vol. Selon lui, 36 passages de l'ouvrage des requérants reproduisaient des procès-verbaux relatifs aux déclarations faites devant le juge d'instruction, et quatre annexes du livre était constituées de "fac-similés d'écoutes" identiques aux documents figurant en procédure. Le 10 septembre 1998, le tribunal de grande instance de Paris jugea que tant les fac-similés que les extraits de procès-verbaux provenaient du dossier d'instruction auquel ne pouvait avoir accès que des personnes tenues au secret de l'instruction ou au secret professionnel. Le tribunal estima que les requérants, journalistes expérimentés, ne pouvaient ignorer que ces documents étaient couverts par le secret de l'instruction ou le secret professionnel. En conséquence, il les déclara coupables du délit de recel de violation du secret de l'instruction ou du secret professionnel. La cour d'appel de Paris confirma cette condamnation le 16 juin 1999.
